1. Overview of Services

Business System Engineering provides AI-driven solutions, such as virtual assistants and process automation tools, designed to help businesses manage and streamline their operations. Our AI Voice Assistant is an intelligent system that answers calls, engages with customers, and helps convert leads into clients.

2. Use of Services

When you use our AI services, you agree to provide accurate, up-to-date information that will help us configure and personalize your AI assistant. You are responsible for the completeness and accuracy of the data you provide, including but not limited to:

- Company information

- Service descriptions

- Customer interaction preferences

- Personal details required to train the AI for your business needs

3. Trial and Subscription Services

We offer a 2-week trial for our AI Voice Assistant service. During the trial period, you can evaluate the performance of the AI assistant without any obligation to continue. If you choose to continue using the service after the trial period, a monthly subscription fee will apply, as per the terms agreed upon at sign-up.

4. User Responsibilities

You are responsible for ensuring that your use of our AI services complies with all applicable laws and regulations, including but not limited to:

- Data protection and privacy laws regarding the information provided to and processed by the AI

- Ensuring that your customers are aware when they are interacting with an AI system

- Proper use of the AI assistant to avoid inappropriate, illegal, or harmful activities

- The user agrees to provide consent or disclosure to their customers regarding AI interactions where required

- It is the user’s responsibility to verify and comply with any applicable laws in jurisdictions where they use the service

You also agree that any content or data shared with the AI does not infringe on third-party rights, including intellectual property or proprietary rights.

5. Usage Fees for AI Voice Assistant

By using our AI Voice Assistant service, you acknowledge and agree to the following usage fee structure:

Per-Minute Charge: For each call handled by the AI Voice Assistant, there is an additional fee of $0.12 - $0.17 per minute, depending on the AI configuration. This charge applies from the moment the AI begins handling the call until the call is completed.

Billing and Payment: The total call time will be calculated on a per-minute basis, and the corresponding fees will be billed to your account.

You agree to pay all fees associated with the AI Voice Assistant usage, as detailed in your invoice.

The billing increment is rounded up to the nearest minute. This will prevent any disputes over partial charges.

Automatic Payment: These usage fees will be automatically charged to your chosen payment method along with any subscription or service fees for the AI Voice Assistant.

Acknowledgment of Charges: By continuing to use the AI Voice Assistant service, you accept and agree to pay these additional usage fees as part of your service agreement with Business System Engineering and The Mind Engineer.

6. Data Privacy and Security

Your privacy is important to us, and we are committed to protecting your personal and business data. Business System Engineering and The Mind Engineer LLC employ reasonable industry-standard security measures, including data encryption, access controls, and regular security audits, to safeguard your information from unauthorized access, disclosure, or loss.

This information includes, but is not limited to, business details, customer interaction preferences, and any other data necessary for configuring and optimizing the AI assistant. All intellectual property related to the AI Voice Assistant and other services, including but not limited to algorithms, software, and content, remains the sole property of Business System Engineering and The Mind Engineer LLC. You may not copy, distribute, or reverse engineer any part of the service without our express written consent.

9. Modifications to the Service and Terms

We reserve the right to modify, update, or discontinue any part of our services at any time. We may also update these Terms and Conditions periodically, and it is your responsibility to review them for any changes. Continued use of the services after changes are made constitutes your acceptance of the revised terms.

We reserve the right to suspend or terminate your access to our AI services at any time, without notice, if you violate these Terms and Conditions or engage in inappropriate use of the service (such as harassment, spamming, or using the AI for fraudulent activities).

11. Limitation of Liability

To the fullest extent permitted by applicable law, Business System Engineering, The Mind Engineer LLC, and their affiliates, officers, directors, employees, and agents (collectively, “we” or “us”) shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of, or inability to use, our AI services. This includes, but is not limited to, loss of profits, revenue, business opportunities, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Cap on Direct Damages:

Our total liability for all claims arising from or related to these Terms and your use of the services shall be strictly limited to the total fees paid by you for the applicable services during the twelve (12) months immediately preceding the date of the claim.
